Key Wizard Scotland – Vehicle Damage and Programming Liability Disclaimer

Website: www.keywizardscotland.com

1. About this disclaimer

This disclaimer applies to vehicle entry, diagnostics, key replacement, key cutting, remote key fob work, and key programming or coding services provided by Key Wizard Scotland (“we”, “us” or “our”).

By asking us to carry out a service, you acknowledge the information in this disclaimer. It does not replace any separate service terms or agreed quotation.

2. Vehicle systems and programming

Automotive locksmith work may require us to access a vehicle’s secure systems, immobiliser, electronic control modules, locks and related components. The outcome can depend on the condition and configuration of the vehicle and its existing systems. We cannot guarantee that every key or remote will programme or code successfully.

A key or remote may fail to programme fully, or a service may be delayed or unsuccessful, because of an underlying or pre-existing vehicle issue. Examples include:

  • a faulty immobiliser, control module or other electronic component;
  • electrical faults, unstable voltage, or a weak or failing vehicle battery;
  • damaged, worn or defective locks or wiring; or
  • previous repairs, aftermarket equipment or modifications affecting the vehicle’s systems.

We are not responsible for an unsuccessful or incomplete programming outcome, or for loss or damage, to the extent it is caused by an underlying or pre-existing vehicle fault or condition rather than by our failure to provide the service with reasonable care and skill. If we identify a possible issue, we will explain it to you where reasonably practicable.

3. Battery condition

A vehicle battery in good condition and providing a stable, constant current is important for successful programming. Please ensure the battery is in suitable condition before work begins and tell us about any known battery or electrical problems. A weak battery or interruption to the vehicle’s power supply may prevent programming from completing or may affect the vehicle’s electronic systems.

4. Vehicle damage and limits on liability

We will carry out services with reasonable care and skill. We are not liable for loss or damage to the extent that it results from:

  • a pre-existing defect, fault, damage or condition of the vehicle;
  • inaccurate or incomplete information supplied by you;
  • a vehicle’s design, manufacturer restrictions, or incompatibility with a key or component not supplied by us; or
  • your failure to follow reasonable instructions given by us.

Nothing in this disclaimer excludes or restricts liability where the law does not allow it. In particular, it does not exclude or restrict our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for failing to provide a service with reasonable care and skill. It does not remove any other liability that cannot lawfully be excluded or restricted.

5. Consumer rights

If you are a consumer, your statutory rights under the Consumer Rights Act 2015 and other applicable UK consumer law are not affected by this disclaimer. This includes your right to have services performed with reasonable care and skill. Where a service does not meet the applicable legal standard, you may have rights to require repeat performance or an appropriate price reduction, subject to the law.

6. Charges and unsuccessful work

Any diagnostic, labour or other charges that may apply if programming is unsuccessful will be explained to you before work begins and are payable only in accordance with the terms agreed with you.

7. Governing law

This disclaimer and any dispute or claim arising from it are governed by the law of Scotland. This does not limit any mandatory consumer protections or rights you may have to bring a claim in another competent court.
